Late Night Driving Restriction Query - Advice Needed Please!

Hey Guys,

I will be on my open license when I return from my 3 month loss of license, however I will have the late night driving restriction (11-5) for a year. What is the penalty if you are caught driving on a LNDR? Is it just a 3 points and $300 fine?

Pretty big penalties. And fines.

Just don't do it?

Unless you need to work?

Then apply for a Late Night driving Exemption.

But dont apply for that if you dont need it. Otherwise you ll get Raped hard as fuck.

Ha, I don't know why people go the "3 month suspension" then added "Late Night Driving Restriction"

Why not of just done Good Driving Behaviour for a year? While on Good Driving Behaviour, you are under that Late Night Driving Restriction..

Not hard to do GDB, I did it and I am a Red P Plater and still did the exact same shit I did off it. I just didn't drive after 11.

You are classified as an Unlicenced Driver in between 11-5. So if you crash, good luck with the insurance, you will get fines for not having your licence, breaking your LNDR.

You can be charged with unlicensed driving and you will be required to appear in court. If your charge is proven the court can disqualify you from holding your licence up to 6 months as well as a fine of up to $3000 or 1 year imprisonment

If you lost your licence for 3 months on your P's you will have to hold your P's for an extra 3 months to compensate for this lost time before moving to an Open licence.
(Not sure if these are your circumstances, just making a note)

The maximum penalty is a fine of $2000, and 3 demerit points.

Unfortunately that's not quite correct.

A LNDR is essentially a 'condition' of your licence, in much the same way as being restricted to driving an automatic vehicle is a licence condition.

If you are caught driving between the hours of 11pm and 5am with an exemption, you are contravening a condition of your licence. As you still hold a licence (that is not suspended/disqualified), by definition you are not unlicensed and as such, you will not be charged with that offence. In regards to any potential insurance claim if it comes to light you were contravening a LNDR at the time of the incident, you are quite correct, they certainly won't be in a hurry to pay up!

So much wrong infomation in this thread but XXXXgold wrote what you need to know

Cops are really hard on it they "were" going to charged for diving a few mins before 0500hours even though they pulled me up at about 0515 hours

14J Contravening late night driving restriction

The number of points for a contravention of section 22F(3) of this regulation is 3.


In saying that, the (demerit point) penalty for contravening a condition of your licence is 1 point. It is possible that a police officer who is unfamiliar with LNDR's and the applicable legislation has erred when issuing the TIN in your particular case.

As i stated above, the maximum demerit point penalty is 3 points, and the maximum fine is $2000.

Fuckkkk why do you guys speak so much shit if you don't know what is is ?

I've been caught on this actually after i lost my license i used to drive after 11, one night got caught and all that happens is ... 3 points and a 300 dollar fine.

Note, 1 penalty unit is currently $100.

if you put 2 and 2 together,

for Open license with 12points.. yes its a 3point $300 fine (or whatever a cop is feeling like at the time)

P plater who took a 3month suspension with 4 points back.. as above..

P plater on Good behaviour.. 3points $300 fine... = loss of license for 6months and then another 12months LNDR haha

well if you read the peice of paper they gave you that told you you have a late night driving restriction you will see they will take you to court with high penalties

sorry xxxxgold, i wasnt refering to your information in my comment, i completely agree with what you have stated as the maximum penalties, however in being done for this offence before, my experience obviously didnt attract that and i doubt many will, though it is a possibility to be aware of..
