Hey Guys, I will be on my open license when I return from my 3 month loss of license, however I will have the late night driving restriction (11-5) for a year. What is the penalty if you are caught driving on a LNDR? Is it just a 3 points and $300 fine? Thanks, Skiiboy90. -------------------- ...... BMW E36 325I Coupe ......

If you lost your licence for 3 months on your P's you will have to hold your P's for an extra 3 months to compensate for this lost time before moving to an Open licence. (Not sure if these are your circumstances, just making a note) |

The maximum penalty is a fine of $2000, and 3 demerit points. You are classified as an Unlicenced Driver in between 11-5. So if you crash, good luck with the insurance, you will get fines for not having your licence, breaking your LNDR. You can be charged with unlicensed driving and you will be required to appear in court. If your charge is proven the court can disqualify you from holding your licence up to 6 months as well as a fine of up to $3000 or 1 year imprisonment Unfortunately that's not quite correct. A LNDR is essentially a 'condition' of your licence, in much the same way as being restricted to driving an automatic vehicle is a licence condition. If you are caught driving between the hours of 11pm and 5am with an exemption, you are contravening a condition of your licence. As you still hold a licence (that is not suspended/disqualified), by definition you are not unlicensed and as such, you will not be charged with that offence. In regards to any potential insurance claim if it comes to light you were contravening a LNDR at the time of the incident, you are quite correct, they certainly won't be in a hurry to pay up! |

Taken directly from the Transport Operations (Road Use Management - Driver Licensing) Regulation - 14J Contravening late night driving restriction The number of points for a contravention of section 22F(3) of this regulation is 3. In saying that, the (demerit point) penalty for contravening a condition of your licence is 1 point. It is possible that a police officer who is unfamiliar with LNDR's and the applicable legislation has erred when issuing the TIN in your particular case. As i stated above, the maximum demerit point penalty is 3 points, and the maximum fine is $2000. |

I've been caught on this actually after i lost my license i used to drive after 11, one night got caught and all that happens is ... 3 points and a 300 dollar fine. Again, taken from the Transport Operations (Road Use Management - Driver Licensing) Regulation - (3) The person must not drive a motor vehicle on a road between the hours of 11p.m. on a day and 5a.m. on the next day during the period of 1 year after the relevant date, unless the person— (a) has a current certificate of exemption issued under section 22G; and (b) is driving in accordance with the certificate. Maximum penalty—20 penalty units. Note, 1 penalty unit is currently $100. While $300 may be the 'normal' fine, it is certainly not the maximum that can be applied for contravening a LNDR. |
