hey i have a qld licence and i dont know whether police from different states (eg. nsw, vic, etc) can take demerit points from you when your in their state. is i have a turbo car and im on my p's

Doesn't matter what licence you hold - you drive in that state you abide by all of their rules. If you are on your P plates and the restriction is no turbo then yes you will be fined. |

yeah i know i will get fined but ive been told they cant take any demerit points in a different state, and thats all i want to know. |

You incur the demerit points from the state your in... so in NSW, with the current 'high' demerit points you would be likely to lose all you points in one hit |

unless you have a license from overseas yes you can lose points. But licenses are cheap over in Thailand or Bali and very easy to get. A co-worker of mine bought a legit drivers license from the Philippines last year and hasnt looked back. WTF? is that legal?? |

\i throught u were only alowed 2 drive on a diif licence 4 like 3 months then u had 2 change it cuz this is what the cop said when me mum moved ova from NZ n the copper was like u need 2 get an aus licence cuz its been ova 3 months... dont know if its thesame for other contreys tho |

i have a friend who lives in nsw but holds a ACT P1 licence who also owns an ss commodore. she is practically untouchable for driving a prohibited vehicle in nsw because in canberra there arent restrictions on what can/ cant be driven on Ps. |

It's really quite simple and has been covered a number of times before. The conditions/restrictions imposed by the licencing state (not the state in which you are driving) must be adhered to. To illustrate, if you are a QLD provisional licence holder and you are caught driving a V8 in the Northern Territory, you can (will) be fined despite there being no vehicular restrictions in the NT. Conversely, if you hold an NT provisional/probationary (whatever it is called up there!) licence and are 'caught' driving a V8 in QLD, you will NOT be fined. If you are caught speeding etc interstate, of course you can be fined and demerit points may be applied although in many cases it appears that demerit points 'accrued' interstate somehow disappear and are never applied. It is worth noting that demerit points (if applicable) will be applied in line with the licencing state's demerit point schedule. If a QLD licence holder accrues what would ordinarily be 3 demerit points in NSW during a double demerit period (and would therefore constitute a 6 point penalty), only 3 demerit points would be applied in QLD (assuming a similar offence in QLD would attract 3 demerit points) due to QLD not having double demerit periods (disregarding multiple speeding offences). As for obtaining an international licence, if you were found to have obtained the licence 'fraudulently' (in that you failed to fulfill residency/citizenship requirements ordinarily required of licence holders in that country which would almost certainly be the case if you 'bought' the licence), you will be considered to be driving whilst unlicensed. Depending on the circumstances in which you acquired the international licence, you may also be charged with uttering. Perhaps unlikely, but certainly possible. Thank you. |
