Nsw Red P To Green P Rules

Hi guys,

Sorry I don know what to put for the topic title. But yeah, I have got a speeding penalty notice letter where it says it will takes 4 demerit points off me (place of offense = NSW). During the date of offense, I was still holding NSW Red P. So in fact, i should get suspended for 3 months because my demerit points limit can only reach or exceed 4. But i haven't paid the fine yet, which means I'm still legally can drive. I did Green P test (HPT) and I passed it after the date of offense and before the penalty notice payment due. So.. will i still get suspended? will the 4 demerit points taken off from my green P (7 points) or red P (4 points)?

To make it clear:

Everything is in Nsw: license and place offense
Date offense: 13 feb
Date Ive got Green P: 20 feb
Payment due: 16 march

I need help please!! sorry for the bad english and im newb for this forum too. Correct me whenever u can. if u need more info please tell me. Thanks!

u will still hold a licence. u will hold green ps or p2 however and u will only have 3 pioints left as they will take it off your current licence.

not sure how it is in nsw but in qld IF we had the 7 points thing u would loose ur licence due to the fact of the offence being back dated to when u were on ur red p plates, best thing as this is a mostly brisbane based webpage is to ring up the DOT near u and ask.

i think its funny people come on here to ask something they could get the answer to with a phone call to DOT.

In QLD you would be screwed because the date of the offence, when guilt is admitted/established, is the date in determining when the demerit points are applied to your licence.

But years ago, whilst still on my provisional licence i got 2 fines within a day of each other, both in NSW, that would have pushed me over the 4 points allowed in QLD. I basically forgot about them for about 3-4 months which by the time i was on my full licence, and then i got a lovely letter from SPER letting me know that my fines had been referred to them, plus a healthy administrative fee of course. I paid them immediately, expecting a letter in the mail asking me to surrender my licence but the letter never arrived. And as this was about 8 years ago i'm not expecting it anytime soon!

Now i have absolutely no idea if the reason for me keeping my licence was the fact that i had since gone to a full licence (unlikely, because i checked and no demerit points at all were ever applied) or if at that stage NSW and QLD didn't have reciprocal demerit point arrangements (i'm told they now do) or if it was just dumb luck!

So in short i am of no help whatsoever! But back in the dark ages, in a similar situation (albeit different states) i managed to keep my licence. Good luck with yours!

Don't quote me on it, but I am pretty certain you should be fine as the points are only taken off once you pay the fine.

Shcool zone I'm guessing.

As far as I'm aware NSW hasn't yet closed this loophole and takes it from the date of payment.

In QLD though, it's from the date of offence, as they realised the loophole was being abused by a certain person..
