Swapping Cars - wanna know what the go is

Hey everyone... I just wanna know what the usual go is or if anyone knows the legalities of swapping someone cars in QLD.
We're both in QLD so no intestate rego issues.

Both cars are rego'd
as far as i know neither have RWC, but should both pass no worries
If i drive 400km to this bloke's place, swap him cars, then what do i do?
chance getting home unreg? or should we both get RWCs to make it easier?

Also what sort of paperwork do you have to fill out with transferring ownership

1st make sure his car has no money owing on it and its has no finance on it, and if it does stay clear unless he has a letter from finance company or the bank the loan is with saying he can swap. And if you owe money on your I suggest you ask your finance company if you can swap.

I would ask him to get a rwc and you get one for your car to.

As for the paper work, you still have to fill it out as if it was a sale, you will need to put down a price and yes you will have to pay transfer and stamp duty.

Its excatly the same as if it was a sale, it actually still is a sale. The consideration you are providing each other is a car instead of money.

legally...

* if the cars are to remain registered. both should have a RWC upon sale. and ideally you should both do REVS checks etc. fill out necessary transfer papers and take them and RWC to Trasnsport within 14 days to swap rego into your name.

if the vehicles are not to remain registered, no rwc is needed. but a receipt should be kept for the vehicle and all necessary details from the current owner to aid in re-registering the vehicle.




however alot of people do the following. its the easiest, but can come back at you and bite you in the ass.

have done many times without any problems. but its the risk you take.

So if you go this way... does my car, stay with the other bloke, registered in my name, until such time as he gets a RWC and swaps it over?

in theory....correct. one of the downfalls if you swap to someone dodgy who doesnt do it. and just wants to use up the rego and drive it around then fuck it off.

filling out the paperwork etc, and a receipt with a time and date of taking possession, signed by both parties will help if something happens, Eg: used in a bottle-o ram raid etc. but u may get done for selling a vehicle without a rwc etc.

most guys are legit, and want it in their name as quick as you want their car in your name. but like i said. it is a risk u take

if you have concerns... do it the legal way smile.gif which in theory u should be anyway haha

one bit of advice for you lad......make sure you got some coin saved up just in case something happens with the new pride n joy because take it from me it SUCKS when you swap a car and it shits itself 2 weeks later.....you know the maintainace on yours, you only know WHAT HE has TOLD you re his....

but dont let that sway you from your dreams...

what i also do when swapin stuff or buying cars with the receipt both of u put ur licence numbers on it so u kno the guy isnt makin up a fake name and shit and so u have some details of him u kno are right for a fact

What do you usually do for a receipt... I'm not a business and I don't have a receipt book or anything lying around - do you just type something up saying this is mine, this is the "trading value" of it and both of you sign it?
