It feels like every day we have less freedom. I hate the current government. Everyone who gets done should go to court and keep appealing and complaining and campaigning until the government has no option but to get rid of these laws. The only problem is that the police are only going to target imports, so the general public wont be affected and wont care.

Im with all fairness for the drink driving/unlicensed etc, but the modification laws from my point of view are just way to harsh. Feel free to disagree, but what is the actual go as people have already mentioned in terms of laws superseading other laws, if your pod filter for example complies with the laws which have been in place for a long time (being secured in the engine bay, or having it sectioned off from other parts of the engine bay) will these new laws just over-ride them and say, no that's not suitable ull need to have that mod-plated?

The new laws DO NOT affect the Gold Coast for another 12 months. BUT if you drive through the other areas e.g. Ipswich or Noosa you are subject to the laws.

so say u go to a thing up the coast or out at willobank to watch u can get done to.

These are NOT NEW LAWS.

Those clauses have existed for years, the only difference is that the car could be impounded for breaching the Vehicle Standards Acts. You've always been able to be defected for modifying your exhaust. However the people who ever get those tickets tended to be the ones who were complete smartass's to the officer and were asking for it.



You thought they'd take your car and give you the money for it? Hahaha. This isn't taking your house to build a freeway. You broke the law no less than four times for the same thing, as a result they're going to do something to really get the message through.

I see nothing, apart from the topic starter's INTERPRETATION of what they BELIEVE is coming out according to a MEDIA report. I can see nothing that says any modification that isn't a factory item or blue plated is illegal. I see it saying if it doesn't meet the Vehicle Standards, dictated by ADRs and NCOPs, it will be illegal. Just as it was. If you put a pod filter on and it's secured, there's no problem. If you put new wheels in and they do not change the rolling diameter by +15mm/-26mm and have the correct load rating, there's no problem.

Besides - Am I the only one to know very similar laws already apply in Victoria?

You know if you're ever imprisoned, your right to engage in ANY sexual activity is revoked? Your right to property is revoked. Your right to go anywhere is revoked. Your right to communicate with anyone is substantially limited. The list goes on.

There's no real difference here. You broke the law doing the same thing four times, you are therefore being punished with more than some points and a fine.

And what does America has to do with anything? Freedom of Speech is a Constitutional right in America. Australia does not have a Bill of Rights (ever wondered about those referendums?). Freedom of Speech is not a legal right in Australia.

well when u have been defected driving a stock standard vehicle with a factory cold are intake then how are these laws fair? also under the laws anything apart from the factory fitted exhaust size is illegal, as there already is a law that says that u cannot change ur exhaust diameter from factory standards however it is rarely enforced, now with these rules getting stricter id be willing 2 bet nearly everyone on this site has there exhaust modified, even urself
btw my ride is legal and all engineered, however with the changes i am now doubting quiet a few things still will be legal although prior 2 it they were

Just spoke to Traffic Branch.

The onlything that has changed is the penality i.e. you go to court.

and

if busted for an offence under the same 'umberella' i.e illegal mods, in a 3 year period.... you get 48 hours with the car you were driving when busted (yours or not)

e.g.

You can have an after market steering wheel as long as is is of the legal size and not made of wood (for example)

you can have an after market exhaust....as long as it complys with noise limits etc, etc, etc.

Basically..... no more fines and loss of points.... every offence goes to court where the penality is decided by the magistrate.

So....... do the right thing and you'll be fine. Don't let the Government and do-gooders in society win. Keep it legal and stay on the road.

So....

If it was a legal modification that does not require a Mod Plate..... it still doesn't (eg steering wheel)
If it was a legal modification that requires a mod plate..... it still does ( eg engine conversion )

There are no new laws.... just the way in which penalities are dished out have changed. i.e. off to court for a lot of things now.

Remember this is not in Brizzy or the Gold Coast.(yet)

Now we have the facts stright, Its actually not a bad idea.

All tho, I would assume giving somebody a court apperance date is less paper work then a defect

But not to bad none the less, If its sometime small, Or if the traffic police ACCIDENTLY get it wrong, And your mod is legal, Atleast you get a fair go at court to explain and tell them its legal.

I hope they also do this for unroadworthy cars tho.


All in all, Im actually happy about the way they will now handle defects. Like RX4_guy above me said, no more bs defects
