$300 Fine For Driving Through An Orange Light - Can anyone clarify the road rule?

Hey,

So i was driving along the road, was really empty except for a car behind me. The lights went orange, so I continued through them at the speed limit. The car that was following me went through the red, undercover cop car, flicked on the lights.

The fine was $300 bucks and 3 demerit points. The fine stated "proceeding through an orange light". Now, as far as I am aware, this is not an illegal. My understanding is that if you proceed past the lines when the light is red, that is an offence. I have seen other forums that have this topic, and it is illegal, but they are for other states.

Anyone in Qld that can clarify for me? should I contest this?

(Granted, I did have enough time to stop, and it was safe for me to do so. None the less, its the principle of it! I didn't go through the red)

Pretty sure the idea of an orange light is to stop if its safe and continue through if its not. If it looked to the officer like you had a safe distance/time to stop (like you admitted) it would be an offense.

your fine is legit if you can "safly stop" which by your own admission you could have it is infact an offence to proceed through an orange light.

the yellow is the beginning of the red phase not a continuation of the green.

That fine is fucking horse shit. Pretty sure that penalty is the same as running a red. Who the fuck dreamt up that?

Also curious. This is one of those laws that is rarely enforced (in relative terms of those who commit the offence oppose to those who are caught.) and the police must either be having a bad night, haven't reached their quota or you have a car that attracts the wrong kinds of attention.

it is kind of like the law about the steering wheels having a padded centre.

now all of a sudden people are posting up saying how they got nicked for their aftermarket steering wheel.

its one of those things, could have been a noob copper, or they were having a slow night, haven't hit target and found an easy $300 to go towards the end of year bacon ball

OP's description of events does sound like some application of the brakes would've saved being pulled over (for disobeying light signal at least) anything else they'd still be keen on.

I got this exact fine from a disjointed cop who couldn't find a defect.

I took it to court and the fine was reduced to $20 and no demerit points, this was in 2006 though and no doubt all the fines and demerits have increased.

When Officer Hardass said he was going to fine me for going through a yellow light, just kept my trap shut because anything you say can and will be used against you...in a court of law. :D

Just take it to court buddy, claim you had fears you would cause an accident by stopping, bam, you'll get cleared. I got pulled over late last year by a cowboy for basicaly the same thing on beaudesert rd. 80k zone lights just changed to orange, if i did stop, it would of been a handbrake and foot flat to the floor skid, smoke etc type job. After being in a rear ender that has and will effect the rest of my life, i wasnt risking it for some 1/2 arsed attempt at extracting money from motorists.

I was calm at the start of our argument but by the end i was letting him know exactly what i though, pretty much after i stated i feared for my life, conversation over. He gave me a warning, i gave him one too!

I got done for that years ago on the Esplanade at Surfers - $30 fine and no points at the time.

But yeah, your question has been answered - If it is safe to do so you must stop.

Yea it wouldnt be a walk in the park, i do belive and i do stop if safe. But there is an element of peoples opinions there. What is safe for you and safe in your mind, might not be safe for others. Speed and conditions also play a part as well as the surroundings.

In my situation described above, i was in the right i believe. Speed, conditions and surroundings all played a part in the fact i was not going to stop.

I was also pulled over just over a hill in a blind spot, there was nearly an accident right infront of us. You know, people having to slow to 40k's because of flashing lights.

I have been done for this before, not much you can do.. Funny how the fine seems to go up every year.. When i got done in surfers last year it was $225 and 1 point....

Just for shits and giggles.. OP can you answer the question about the police officer and how close he was travelling to you?

If it was one of those wankers who sits close to your tail, just take it to court and claim that you were afraid to brake as you believed that you would instigate an accident by doing so. This will be easily feasible if the police officer in the undercover car was tailgating/travelling too closely.

I also like to know if the cop car put its lights on befor or after it was in the set of lights? becaues if the cop went through the set of lights without his lights on then you could make that a point in court. If he felt that it was safe for him to enter without lights on then it must of been safe for you to enter the set of lights

No, you don't have a point.

The only loophole you could question in this situation is if the police vehicle was tailgating you at a close distance which could have caused an accident.
