Buying/selling A Defected Car - whats the deal?

Hey all,

i'm just wondering what the deal is with buying a defected car? Illegal or not? car is out of rego btw

If one is bought, can the new owner clear the defect? or must the original owner..

this may change state to state, not sure though? but im in SA.

Soo, whats the deal?

I think in QLD, you have to sell unreg'd. Like, selling without a roady. You're not allowed. I could be wrong though.

My bf's skyline had a roadworthy when he purchased it, we went to the spit the other weekend- turns out his BOV was a defect
(he told them it was purchased like this with a roadworthy- basically they said they don't care- It's his car now- luckly only a warning though)

He was given a self declering defect form he had to fill in and send back.. they didn't even ask him to take it in anywhere to make sure it had been done.

Good question about SA laws though? I always thought it was up to the owner of the car dunno.gif

It'll be put into the police system, so next time they run his plates it will come up and most likely pull him over and check.

He fixed it well before the defect form had to be sent back so no worries there.

Only a warning, but he got defect form? How does that work..

he got a warning for having a defect.. (no points or fine- was just told to fix it within 21 days i think it was) and was given a self decleration to send back to say it had been done

next time it would be a defect- but there won't be a next time smile.gif

once it is handed over its their responsibility to fix the defect and you have to sell it without rego saying as is then out of hands

well ive been told its illegal to sell a defected car? but im not sure if thats entirely true

maybe ill call regency tomorrow see what the deal is, cant hurt

If it is not registered it doesnt matter... Otherwise how would you sell a track, drag or rally car?

Check the SA transport website, im sure it will have info on whats needed when selling a car...

It isn't illegal as such but if it comes up you get in alot of trouble unregistered or not. The vehicle must be cleared of the defect prior to sale if not and you get caught out prepare to get your ass raped. The only time you can get away with it is if the vehicle will never be registered again e.g. written off or turned into a track car or something. But even then you must send in the defect with proof that it has been deregistered prior to when the defect needed to be cleared and they then flag that VIN number so if it is registered again, hello little knock on your door.

That's in qld anyways not sure about SA maybe call the road authority and ask

When I sold my car. It had run out of rego and was defected (just left it in the backyard).

I had to make a form saying that: I (insert name here) of (address) am selling my (car -make, model, year etc.) to
(buyers name) of (their address) etc.etc. Included in this I made a note about the fact that the buyer knew the car
was defected (also made note of what the defects were) and that they agree that it is their responsibility to clear it
should they want to register it.

I made two copies, one for each of us. Then we both signed and dated it and had witnesses.

Well in QLD. it is the law to sell the car with a RWC. and if it is defected then no RWC and no sale. Simple as that.

Remembering that only applies to registered vehicles, if you are selling an unregistered car you don't require a safety certificate.
