Ok so basically some sick perverted F*CKWIT is ringing up my mother at all hours of the night making all kinds of sick remarks he also has started to ring our house phone so if there is anyone that could pull some strings for me and find out a name / details i would be very appreciative, im not going to hurt the guy just want to call him tell him his name to show him that i know who and where he is and what may happen if he keeps trying this shit. Take your mother down to police station and file a sexual harrasment complaint, unfortunately theres probably not much else you can do other than get the number blacklisted (if possible).

can be put in a call report to telstra, after 2 warnings the next reported offense gets them blacklisted. Also go to the cops, speeds up the process

If you call Telstra even giving them his number, pretending to be him, they'll ask to verify the basic details before they give you any other details about the account. It's all about the privacy act! No hope there. As mentioned, best to get someone in a Telstra shop to try and find out for you if you know someone, they can look it up right there and then, illegal as it is.

Police won't do anything about it, neither will Telstra. Basically, the alleged offending user has to of made threats against a persons life, to have the Police involved. Telstra policy would be the same as Optus i would assume (used to work for them), in that they will offer to change your mothers number free of charge so that he will no longer have it. It's up to her whether she accepts that offer, but that's about all your options unfortunately.

Good luck with this dude, but your best bet is change the number (i know i know, you shouldn't have to), or find someone you know that works for Telstra mobile either in store or through one of their call centres.
