hey all, was in town last night and was going down the road towards jetty surf to turn up to go to hungry jacks, (at about 10:45pm) and happened to go through an orange light just near jetty surf, i would of stopped but i didnt realise it was orange untill i was just near the line, and i got pulled over and booked 3 points and $80 for "failing to stop at a yellow signal"...now can one person here put their hand up and tell me this is fair? because i sure dont think it is, thinking of desputing it, needing some help on what to say if anyone has some suggestions they would be greatful....

according to the book you only have to stop for a yellow if you can do so safely... as long as your wheels are over the line before its red it should be good... according to the book that is

well i assume it was orange before i got to the line but i didnt notice, but i was over the other line before it was red, and there was F#$cking no one about at all, apart from jake (harolto) behind me!!!

gggrrrr wish the 5-0 would just to their job and leave me alone, they should go arrest all those lifeless kents stealing cars and stuff from cars!! GGGRRR

what speed were you travelling at? could you have 'safely' stopped i.e. there were/weren't car behind you?

if you really think you could not have stopped safely, you should dispute the infringement.

i suggest you write an appeal letter now and send it in tomorrow to the police commisioner. more often than not, they will reject your appeal since this infringement is largely based on either recorded evidence or on the discretion of the police officer.

after which, send a request for discovery, which is in essence an obligation of govt. bodies to citizens regarding 'free' information under the commonwealth 'freedom of information act' . in this request, ask for any recording evidence of you crossing the traffic light, and thus causing a hazard to other road users. if they do have any evidence, pay up and take the points.

if they don't, prepared to get legal counsel or represent yourself.

likely scenarios:
1) you will end up paying more than 80 bucks+3 points (inclusive of court costs and legal fees)
2) if the police officer who booked you does not turn up in court (don't count on it), the fine is written off.
3) your counsel is able to plea bargain, lightening your fine. (most of the time, you just pay the fine and not take the points) but this also depends on whether you have any prior convictions or have a bad driving record.

if you do need legal counsel, pm me. i work for a fairly large legal firm which specializes in such cases.

Its fair... i attemted to take mine to court and still got done... i was on my p's and they booked me 3pts 110 bucks for failing to obey a yellow traffic signal. amd 1 pnt for failing to display a P plate.. (plate was on the parcel shelf) and anyone that can count knows thats 4pnts and no licence... so unfortunatly theres fuck all you can do

Id be going to court to dispute the situation as well!!!

yeah i was behind him, it would of been unsafe for him to stop as he was probably 2m before the line when the lights turned yellow, doing 50
then the cop doing over 60km/h with no lights on, from the middle lane turned infrount of me around the corner, with no lights on, and no warning at all (could of been dangerous if there were pedestrians) then light went green, i went, was about 2m from the cop car (where he had pulled peto over) and he swung his door open, causing me to break heavily and swerve into the on comming lane. i was abit shaken up and thinkin 'wtf' so pulled over, went upto the officer and said "WTF i just nearly hit your door" he said "i saw you comming mate you were no where near it" then i said "fair enuff whats your badge number?" then the passenger said "piss off" and rolled the window up,
good police work there by those 2 officers, oh well i got their rego and i will be making a formal complaint about both of them tomorrow. and write a letter to transport complaining about the dangerous driving.

Speaking of cops get this.....

Driving down Elizabeth Street inbound in VU_SS_UTE's poser mobile and we approach this cop car doing about 20 clicks. Im thinking ok so someones having a biff outside The Don they must be about to pull over....

NUP rolleyes.gif..... i realised there is a car in front of them. Blue Datto 1000 i think thats the model, fucked paint, roof racks, greenie stickers all over it, charfing out a piston each minute through the exhaust, no headlights, park lights, functioning indicators or brake lights and swerving all over the road whilst doing 20 clicks MAX.

So what do they do, THEY PULL INTO SHELL NORTH HOBART!!!!!!!!!!!

WHAT THAAAAAAA FUCK!!!!

They leave the Datto to continue on its way at 20 clicks causing serious emissions damage to the environment (so bad i had to wind the window up rant2.gif).

I hold no remorse for being done twice this year and copping it on the chin, but this shit is fucking unacceptable! Pity i was that stunned they pulled over to look at the rego plate.

Couldn't agree more with the attitude / wrong approach to policing. I've never had an issue with the police other than being pulled over more for driving an older car.
BUT what happend to me a couple of months ago really changed my mind about them... heres what I posted on another forum, can't be stuffed typing it again:

On presenting me with the caution I let him know I wasn't going to accept it, as he was not behind me long enough to estimate my speed and just assumed that because he had to do a claimed 120km/h, after waiting at the lights, to catch up to me really does not prove I was speading.

Now as you can imagine I was majorly pissed off about it, so decided to write a letter to the police commissioner:

Not really fair, question a caution and they up it to an actual fine... but I wasn't going to accept being cautioned for something I didn't do.

Anyway I'm determined to take it to court. (At best I will win, at worse I pay the $80 plus a $50 summons fee). Just after any advice / stories from other people that have been in a similar predicament, and how you have gone in court if it went that far.

Just can't believe how unfair things are, they apparantly don't have to show you any evidence, then if you aren't happy whats happened and write a letter to them (even though it was probably a bit strongly worded) they can just upgrade the caution / fine out of spite. rant2.gif So much for freedom of speech and being able to defend yourself. wink.gif
So the moral of the story is if you drive an old / modified car and so much as breath the wrong way and your on their priority list to be pulled over / arse raped..... but drive a new unmodified Camry (or similar) and get away with blue murder.

Well, I got pulled over in Old Beach this morning on the way to the shops to get them morning paper.

My front drivers side indicator was out and I've been into the auto sparky already but they are too busy (faulty wiring, not globe!) to fix it straight away.

Cop was OK about it all, older guy sucking a coffee into himself. Explained that the auto sparky was looking at the car on Friday and fixing it next week so he let me off with a warning.

Meanwhile, I notice he was sitting in his unmarked silver VZ, engine running. Hmmm.....no seatbelt, leaving a running vehicle unattended etc...

He was nice enough to me but as above, why piss around with little matters when there are crooks out there doing real damage to society.

I sincerely hope you disputed the fine handed down by the Commander! Take it to court mate. No speed reading = no offence. I have been pulled over for speeding on two occasions, both times I was only verbally cautioned for speeding as they didnt have a reading to prove it. I didnt even need to ask them for a reading, they knew they didnt have one so didnt try to book me for it!

yeah, mum works at transport, and she said compaining to the station, and to trainsport is the way to go, stating i have done a defensive driving couse, and saying that the way the drove/acted was not defensive at all, oh well, solicitor tomorrow, then comapint on wednesday for those fuckola cops, 6 witnesses saw that they opened their door at the wrong time, and took a corner in town at 60+ where poidestrians could of been harmed.

after being abused by a few cop after the past 6months, i wont pull over for any cop out of a populated ared, with out confermation from 000.

Hmmm yeah cops are c#nts to people in modified cars. I got done the other day by a lovely young orange haired female cop >.< Was going along Bligh St. right to the end the po-po are always sitting near the last round a bout so I was watching my speed. Went through the round about and turned around at the end and coming back up. The officer had turned around and was now coming at me with lights on so I pulled over, She comes up to me and goes do you know you only have on P-Plate up, I was like WTF you made all that effort to turn around and caution me for not having a P-Plate up... That was in the Skyline... I only ever have one up when I'm driving the Pintara and I have never been pulled up for it... sitting next to police officers at lights have them behind me past me etc... They need some real work to do picking on stupid issues like we have seen in this post is absolutely stupid!

How hard is it to put another plate up? If you did then there is one less reason to be pulled over. No use whinging about something that you can stop!!

Mate, just tell the 'truth' and stick with it...

How long have you had your licence? Not TOO long? Just say with your minimal driving experence (makes them think they are older and more experenced, also makes them feel good about themselves smile.gif ) you didn't feel it was safe for YOU to try and attempt to stop for the light as you were so close to the intersection when the light changed.

You may also play the 'there was a car close behind you and you were unsure if they would stop in time too'.

i love it when cops tailgate, i tapped my brakes one time on them hahaha. got pulled over straight away and i complained.. they left without even taking any of my details or anything. wish i'd got their number. i also love the random illegal u-turns they do to chase after me sticking to the speed limit, i think next time i'll do one right back at them
i've hated traffic police since i was fined 3 weeks after writing off my car and almost another in an accident in peak hour. fuckers

Most of you should be fairly aware of the 'local' situation anyway, look up Tasmainian Times for some idea...

Even if its just the delay before you get some points back, it is usually worth disputing and the more times this happens brings pressure from the courts to bear on the cops, and makes them(the courts) more sympathitic to you.
If you want to win use the link above and go and watch check the courts out, we are dealing with people here and judges have different personalities. Pick the one you would prefer and see what washes with him, then when your case comes up if it is not with the right one adjourn.


Most importantly, get a statement from any witness's IMMEDIATELY 'cos a fresh memory carries more weight, get it witnessed by JC, this also includes your own statement. From now on it has nothing to do with the police any correspondance with them is via a Lawyer (search llllaaaawwwwyyyeeerrr Duncan kerr for prices and hold them to it) Then its presentation presentation, sorry fellas hipsters are not good!

Alternately you could chuck on some Greens stickers.

has anyone noticed cops parking their cars in the middle of the street all the time for no apparent reason? i was out saturday night and the amount of times they just stop in the middle of the road its like they do it just because they can. they even leave the car unattended for ages with doors open and lights going, engine running and they dont seem to be actually doing anything, i just seen this happen about 5 times in one night and they never use their bloody indicators, they should still obide by the law if they are going to inforce it on others the stinky pig fuckers. no wonder no one likes them.

I remember once i was working on my car (putting carpet in) on the side of road outside my place in west hobart and i saw this cop car come up the street. My street is tiny and the only other time i've seen cops up there was when i called them cos my car got stolen. Anyway they cruise up the road and pull up next to this totally trashed commodore which is always parked there. They stuff around for five minutes so i go back to work. Anyway i hear them start up and roll down the street but i don't hear them go past. i pull my head out from under the dash and this hell sexy blonde cop is grinning at me through the drivers side window. I'm thinking oh no there going to book me for having tools and carpet all over the foot path, but she just waves at me then they drive off!!!
I just couldn't believe how fine that cop was!! What a waste!

Today i was going along the brooker doing the speed limit and i kept getting orange lights.
i don't care what they say i didn't feel confident braking that hard to avoid it so i accelerated and got thru b4 it turned red.

please share with us what you think, i would love to know what the G O is...we all know how everyone feels on here but i think i speak for eveyone when i say we would like to know the other side of the story.....and i still think the police should spend a bit more time and money on cracking down on car thieves

I actually questioned a couple of cops who broke up a CKCP meet a while back why they were harrassing us instead of putting their resources to better use catching those who sell drugs to kids and rape innocent women. Needless to say I didnt get a direct answer.

As for running lights, everyone runs reds down here unsure.gif, prolly the biggest thing i noticed from moving from north, as its rare to see anyone do it up there, so I dunno what they would worry about oranges for.

hmmmm, i guess if the 5-0 "dislike" us "car enthusiasts" as much as we "dislike" them, then its no wonder we are getting pulled up and fined so often, i just think its getting way out of hand for no reason! ggrr....
just remebered once, i was sitting at BP clarence street (just bought a drink etc) was with one other car, and the po-po 5-0 came in and searched both our cars and patted all of us down...wouldnt tell us why and there wasnt any reason for it to happen, its shit like this that pisses me off and makes me feel violated!
